1. Acceptance of Terms

These Terms of Use ("Terms") form a binding agreement between you and Liquid Amber Partners LLC ("we", "us", or "our"), the operator of NativeNurseryFinder.com (the "Site"). By accessing or using the Site you agree to these Terms. If you do not agree, do not use the Site.

2. Description of Service

The Site provides a free, browser-based native plant finder (filter by state, USDA hardiness zone, and plant category), a curated directory of regional and mail-order native plant nurseries, and editorial articles and guides on native gardening, pollinator habitat, and ecological landscaping. The plant finder and directory run in your browser and display plant and nursery information compiled from public sources; they do not sell plants or broker transactions.

3. Eligibility

The Site is intended for users who are at least 13 years of age (or 16 in the EEA/UK). By using the Site, you represent that you meet this requirement.

4. Informational Use — No Warranty

The Site and all content on it are provided on an "as is" and "as available" basis, without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Plant range, hardiness-zone, growing-condition, and nursery-contact data are compiled from public sources (including USDA PLANTS, state native plant societies, the Lady Bird Johnson Wildflower Center, and state extension services) and may contain errors, omissions, or out-of-date information. Plant suitability varies by microclimate, soil, and local conditions; always confirm with a qualified local source before planting. We are not responsible for losses resulting from reliance on plant, zone, or nursery information on the Site.

5. Accuracy of Information

We attempt to keep nursery listings, species ranges, and hardiness-zone data accurate and current. Nurseries close, relocate, and change their offerings; USDA hardiness-zone maps are periodically revised; and plant taxonomy changes over time. Always call ahead or check a nursery's website before visiting, and verify a plant's native status with your state native plant society before purchasing.

6. Affiliate Disclosure

The Site participates in the Amazon Services LLC Associates Program and other affiliate programs. As an Amazon Associate we earn from qualifying purchases. Certain product links on the Site (for books, pollinator-habitat supplies, and garden tools) are affiliate links; clicking them and making a purchase may result in a commission to us at no additional cost to you. Editorial recommendations are not determined by commission rates.

7. Advertising

The Site displays third-party advertising served by Google AdSense and its partners. Advertisers are responsible for the content of their ads. We do not endorse any particular advertiser or product featured in an ad unless explicitly stated.

8. Intellectual Property

All Site content — including text, graphics, logos, tool code, plant database compilations, nursery-directory compilations, and design — is owned by or licensed to Liquid Amber Partners LLC and is protected by United States and international copyright and trademark laws. Plant images are loaded from Wikipedia / Wikimedia Commons and are subject to their original licenses. You may view and share individual articles for personal, non-commercial purposes. You may not reproduce, republish, distribute, scrape, or create derivative works from the Site's database compilations or editorial content without our prior written permission.

9. User Conduct

You agree not to: (a) use the Site to violate any law; (b) attempt to gain unauthorized access to any portion of the Site, its servers, or the accounts of other users; (c) interfere with, disrupt, or overload the Site's infrastructure; (d) use automated scraping, crawling, or data-mining tools to extract the plant database or nursery directory, except for well-behaved search-engine crawlers respecting robots.txt; (e) submit false, misleading, or spammy nursery listings; or (f) reproduce or re-host the Site's tools or content in a manner that presents them as your own.

10. Third-Party Links

The Site contains links to third-party websites, including nursery websites, affiliate partners, Wikipedia, native plant societies, and government reference sources. We are not responsible for the content, privacy practices, pricing, product availability, or business practices of third-party sites, including any nursery listed in the directory.

11. Limitation of Liability

To the maximum extent permitted by law, Liquid Amber Partners LLC, its members, officers, and contributors shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with your use of the Site or reliance on any content — including without limitation loss of plants, garden-establishment costs, damage from planting a species unsuited to your site, transactions with nurseries listed in the directory, loss of data, or loss of profits — even if advised of the possibility of such damages.

12. Indemnification

You agree to defend, indemnify, and hold harmless Liquid Amber Partners LLC and its affiliates from any claim or demand, including reasonable attorneys' fees, arising out of your use of the Site or your violation of these Terms.

13. Changes to the Service and These Terms

We may modify, suspend, or discontinue all or part of the Site at any time, with or without notice. We may also update these Terms from time to time. Material changes will be reflected by updating the "Last Updated" date above. Your continued use of the Site after a change constitutes acceptance of the updated Terms.

14. Governing Law and Venue

These Terms are governed by and construed under the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the jurisdiction of those courts. Nothing in this paragraph limits any mandatory consumer-protection rights you may have under the laws of your country of residence.

15. Severability

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
